1. About FalconView
FalconView Studio provides short-term-rental marketing services, including property photography and video, drone or aerial coverage where suitable, social-media assets, GEO/SEO property websites, domain setup, managed hosting and website maintenance.
2. Adult and business authority
You must be at least 18 years old and have authority to act for the business, property owner or accommodation operator you represent when requesting or purchasing FalconView services.
By submitting an enquiry, approving a proposal or purchasing a service, you confirm that you satisfy those requirements and that the information you provide is accurate.
3. Website information, pricing and enquiries
Website descriptions, package details, prices and availability are invitations to enquire unless FalconView expressly states that a binding offer is being made. They do not create a contract by themselves. FalconView may clarify suitability, timing, travel, location, production requirements, third-party costs and any non-standard work before making or accepting an offer.
The website currently describes three public starting packages: Direct Booking Site at $1,997 AUD, Property Launch at $3,997 AUD, and Signature / Portfolio from $5,997 AUD. First-year managed hosting is included; managed hosting is $297 AUD annually from year two within the published care scope. Domain registration, third-party booking platforms, paid plugins, unusual travel, styling, talent, permits, extra production visits, additional properties or locations, complex integrations, redesigns, new pages and other work outside the stated package scope may be quoted separately. A proposal may vary or further define those details where the project requires it.
4. Contract and order of precedence
A contract is formed only when the parties accept a written proposal, service agreement, order, invoice or other express offer according to its stated acceptance process. The signed or accepted project document controls the specific scope, deliverables, fees, taxes, expenses, payment schedule, revisions, timeline, access requirements, cancellation terms, ownership, licences, usage rights and any special conditions. If that document conflicts with these general terms, the project document controls to the extent of the conflict.
5. Scope, changes and delivery
FalconView will provide the deliverables identified in the accepted project document. Additional shoot days, locations, deliverables, travel, rush work, integrations, structural website changes, major copy changes, custom functionality or services outside the agreed scope may require a revised quote or written variation. Delivery dates depend on timely access, information, approvals, weather where relevant, third-party availability and payment.
6. Client responsibilities and content warranties
You are responsible for providing accurate and timely property, business, booking, access and contact information. You warrant that:
- you have authority to approve property access, photography, filming, drone operations where applicable and publication;
- you own or have permission to supply and use all images, video, logos, trademarks, copy, property data and other materials provided to FalconView;
- you have any notices, consents or lawful basis required before providing personal information about guests, staff, owners or other people;
- the materials and instructions you provide do not infringe another person's rights or break applicable law; and
- you will review drafts and request factual corrections or agreed revisions within the timeframe stated in the proposal.
7. Domains, accounts and third-party platforms
You remain responsible for information, fees, renewals and account decisions associated with your domain and third-party platforms unless the accepted proposal expressly assigns a responsibility to FalconView. Domain names cannot be guaranteed until registered, and registrar, hosting, booking-platform, social-platform and other provider pricing or policies may change.
Do not submit passwords, API keys, recovery codes or domain credentials through the public enquiry form. Where access is required, FalconView will normally request delegated, collaborator or account-invitation access, or guide you through the required change. You are responsible for removing access when it is no longer required and for maintaining secure account recovery methods.
8. Fees, payment, revisions and cancellation
Fees are payable in AUD unless the accepted project document says otherwise. FalconView may require a deposit, progress payment, reimbursement of approved third-party costs or full payment before production, delivery, registration or launch. The accepted proposal or agreement controls included revisions, rescheduling, cancellation, refunds and the consequences of late payment. FalconView may pause work or withhold launch or final delivery while an amount is overdue, subject to applicable law.
9. Ownership and licences
The accepted project document controls ownership and licences for final deliverables, source files, website code, third-party components, music, stock assets, fonts, templates and pre-existing FalconView tools or methods. Unless the project document says otherwise, usage rights for final client deliverables begin after full payment. Third-party materials remain subject to their own licence terms. FalconView will not publish confidential client information and will follow any agreed portfolio restrictions.
10. Third-party services
FalconView may use third-party providers for hosting, domains, DNS, forms, email, analytics, file delivery, communications, invoicing, payments or production. FalconView will use reasonable care when selecting and configuring providers but does not control their availability, security incidents, policy changes, pricing changes, account decisions or outages. Nothing in this clause excludes responsibility that cannot lawfully be excluded.
The website uses Google Analytics 4, measurement ID G-NZG1H0CS1X, to measure traffic and site usage. Google may set analytics cookies and process device, browser, referral, interaction and approximate-location information as described in FalconView's Privacy Policy and Google's own terms and privacy documentation.
11. Marketing outcomes
FalconView creates marketing assets and technical foundations but does not guarantee bookings, revenue, occupancy, rankings, AI citations, search placement, audience growth, platform reach or social-media performance. Results depend on the property, offer, pricing, market, platforms, competition and the client's ongoing activity.
12. Australian Consumer Law and mandatory rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law where it applies. If a guarantee applies and the law permits FalconView to limit the remedy, FalconView's liability will be limited, at FalconView's option, to supplying the services again or paying the reasonable cost of having the services supplied again.
13. Limitation of liability
To the maximum extent permitted by law, FalconView is not liable for indirect or consequential loss, lost bookings, lost profit, lost revenue, loss caused by inaccurate client information, platform account issues, search or social algorithm changes, domain unavailability or third-party service failure. Where liability can lawfully be limited, FalconView's aggregate liability arising from a specific service will not exceed the amount paid to FalconView for that service. This clause is subject to section 12 and any accepted project document.
14. Governing law
These general terms are governed by the laws of Queensland, Australia. The parties submit to the courts with jurisdiction in Queensland, subject to any mandatory law or consumer right that applies elsewhere.
